If Buyer's initial deposit and/or any additional deposits required under the contract are not received by escrow by the time period specified in the contract, Buyer will be considered in default, and Seller may exercise the Seller's remedies in the contract. Time is of the essence in the payment of these deposits.
RELEASE OF
BUYER'S DEPOSITS TO SELLER PRIOR TO CLOSE OF ESCROW.
Buyer hereby instructs
escrow irrevocably and without condition, to disburse prior to closing the sum

In
consideration of escrow releasing this sum as herein provided, the Buyer and
Seller hereby indemnify and hold harmless CENTURY 21 Alpha and its agents and escrow from and against any and all
losses, costs, expenses, fees and claims which may arise or be incurred as a
result of escrow's compliance with these irrevocable instructions for the early
release of funds.
EARNEST MONEY DEPOSITS
Seller has the option to declare this contract null and void, if any earnest money deposits are not made on time as required by the contract or if Buyer's earnest money check does not clear.
