Contingencies


The Buyer may terminate this agreement based on Buyers' reasonable disapproval within 10 (or _______) days after receipt or occurrence of:

1. inspection of property for value and condition sufficient to justify purchase price within _____ days after acceptance hereof.
2. receipt of an itemized inventory of the personal property included in the sale handed to Buyer within _____ days after acceptance.
3. receipt of a geologic report on the property regarding flood hazard, drainage, mud, earth movement or earthquake study zone to be obtained by Buyer within ______ days after acceptance.
4. receipt of a Rental Income Statement itemizing, by unit, the tenant’s name, rent amount, date due and delinquencies, deposits, rental period and expiration, and rental incentives, bonuses or discounts, which statement Seller will certify and hand to Buyer within _____ days after acceptance.
5. receipt of an Estoppel Certificate executed by each tenant affirming the terms of their lease/rental agreement and any modification, which Seller will hand to Buyer prior to _____ days before closing.
6. determination by Buyer of availability of public utilities and services including, but not limited to, sewerage, sanitation, water, power, gas, phone, fire and police within _____days after acceptance.
7. The opinion of an attorney retained by Buyer regarding Buyer's intended use of the property within _____ days after acceptance.
8. receipt of a Preliminary title report for the policy of title insurance to be ordered by escrow and handed to Buyer within _____ days after acceptance.            
9. receipt of an American Land Title Association (ALTA) surrey of the property to be obtained by Buyer from a licensed surveyor employed by Buyer within_____ days after acceptance
10. receipt of a land use feasibility studies to be obtained by Buyer regarding Buyer's intended use of the property within _____ days after acceptance
11. receipt of an environmental impact report (EIR) to be obtained by Buyer regarding the Buyer's intended use of the property within _____ days after acceptance
12. receipt of soil tests and other engineering of the property to be obtained by Buyer as required by Buyer's engineers and architects or by the building department, within _____ days after acceptance.
13. receipt of the Owner’s Association articles, bylaws, CC&Rs, statement of condition of assessments, policy of collecting assessments, current financial statements and estimated operating budget.

Inspection of condition of units.
The Buyer may terminate this agreement based on Buyers' reasonable disapproval of the condition of all units situated in the herein described property within 72 hours of inspection thereof. In the event buyer cancels this agreement based on said unit being unsatisfactory ALL deposits and sums paid hereunder shall be promptly returned to buyer.

Close of escrow is contingent upon Buyers
1. approval of a final subdivision or parcel map by local authorities.
2. receiving an issuance by Department of Real Estate of a final subdivision report.
3. receiving an issuance of building permit for construction of Buyer's proposed development.
4. obtaining a change of zoning or use permits to allow development as intended by the Buyer.
5. closing concurrent with the close of escrow on Buyer's acquisition of other real estate described as: __________________________________________________
6. obtaining a loan to fund Buyer's intended use and development of the property.
7. obtaining hazard insurance on the property improvements.
8. obtaining a loan to fund Buyer’s intended use or development of the property.
9. obtaining closing funds from ______________________________________
10. obtaining funds from the sale of other property referred to as: _________________________________

Listing Subject to Replacement Property
The Sellers obligation to perform hereunder including but not limited to the compensation paid to Broker is specifically conditioned upon Seller purchasing a replace property wherein Broker represent Seller as Buyer's Agent on said purchase.


TIME PERIODS. Time periods in the Agreement for inspections, contingencies, covenants, and other obligations shall begin the day after Buyer removes CONTINGENCY FOR SALE of Buyer's property.(C.A.R. Form COP)


BUYER'S DEPOSIT CHECK. Buyer's deposit check shall be delivered to escrow within 3 business Days After after Buyer removes CONTINGENCY FOR SALE of Buyer's property.(C.A.R. Form COP)
